General terms and conditions 2019


§ 1 scope
The following general terms and conditions apply exclusively between FR-DEIN BARKEEPER and the client. Deviating conditions of the client are not valid.
§ 2 conclusion of contract:
2.1
After a non-binding offer and clarification of all conditions with the client, a written order confirmation is issued, which becomes legally effective with the down payment.

2.1
The deposit must be paid by bank transfer to the specified account within 7 days of receipt of the order confirmation.
§ 3 Services
The scope of the contractual services is recorded in the order confirmation. Later agreements explicitly require written confirmation by Fabian Rehn
§ 4 Price and Payment Conditions:

4.1
All prices are gross amounts (no sales tax according to small business regulations according to § 19 (1) UStG).
4.2
Upon receipt of the order confirmation, the agreed deposit must be paid within 7 days.
4.3
The total amount will be billed after the event. The amount is to be paid in cash immediately after the end of the event or due 7 days after receipt of the invoice without deduction by bank transfer.


4.4
In the event of default in payment, default interest will be charged 5% pa above the base rate; additional reminder fees and, if applicable, lawyer and court fees.

§ 5 Damage
Missing and / or damaged items, including glasses that were not caused by FR DEIN BARKEEPER, will be invoiced to the client retrospectively if there were more than 3 glasses.
§ 6 liability
Claims for damages against FR DEIN BARKEEPER - regardless of the legal reason - are excluded, unless FR DEIN BARKEEPER is guilty of willful intent or gross negligence.
§ 7 Parking lot / loading and unloading
The client provides a parking space for loading and unloading directly in front of the event location.
§ 8 cancellation
8.1 If the order is canceled up to 30 calendar days before the agreed event date, 20% of the agreed order amount is due for payment.
8.2 If the order is canceled up to 14 calendar days before the agreed event date, 40% of the agreed order amount is due for payment.

8.3 If the order is canceled up to 7 calendar days before the agreed event date, 50% of the agreed order amount is due for payment.
8.4 If the order is canceled up to 3 calendar days before the agreed event date, 75% of the agreed order amount must be paid.
8.5 In the event of later cancellation, 80% of the agreed order amount must be paid.

§ 9 Force Majeure

Service delays and failures due to force majeure and due to events that make the performance of the service much more difficult or impossible for FR DEIN BARKEEPER, e.g. strike, lockout, official requirements, storms, etc., FR DEIN BARKEEPER is not responsible for agreed appointments . In this case, FR DEIN BARKEEPER is entitled to postpone the service for the duration of the hindrance or to withdraw from the contract in whole or in part without the client having any claims for compensation.
§ 10 data protection
The personal data of the client are processed and stored in compliance with data protection. It will not be passed on to third parties.
§ 11 place of jurisdiction

The place of jurisdiction is Darmstadt.
